Rules and Regulations
1. Concessionaires will set up on Monday, July 30, 2012 at designated times determined by your
location in the setup. Failure to have concessions available at the designated time forfeits all rights to
the premises as well as the payment made.
2. It is mutually agreed that the rules and regulations of The Fair Association governing the operations
of the Fair shall apply to this contract.
3. A 10 ft X 10 ft space cost $450.00. All front feet over 10 are charged an additional $25.00 per foot.
A trailer 16 ft long on the front would cost $600.00
4. The Fair begins on August 2, 2012 and ends on August 11, 2012. Hours of operation are 5:00 P.M. to 11:00 P.M. nightly. All Concessionaires are to be on the grounds and open by 5:00 P.M. All vehicles are to be off the grounds and parked by 4:30 P.M. Do not drive through the Midway or over power cords. No vehicles will be allowed in the Food Court area until Fair has closed and the Midway is clear of people.
5. Concessionaire agrees to occupy said space during the entire period of the Fair. No concessionaire
will be allowed to remove or dismantle his or her concession before 12:00 midnight on the last day of
the Fair.
6. Concessionaire must arrange concession in such a manner that it will not infringe upon the rights of
neighboring Concessionaires. Concession will be limited to actual space leased and not to extend
beyond.
7. Concessionaire agrees to provide the Fair with a copy of Liability insurance in the amount of
$1,000,000.00 dollars, listing Jefferson County Fair as additional insured. If no insurance policy is
available, coverage may be purchased through the Fair at a cost of $150.00 to be paid by the
Concessionaire.
8. Sub-letting of privileges and spaces will not be permitted except with the permission of the Fair.
9. The Fair reserves the right to restrict any concession, which because of noise or other reason, may
be objectionable and reserves the right to prohibit or remove any display which may distract from the
general character of the Fair. This reservation includes persons, things, printed materials or anything of
a character that might be detrimental to the Fair as a whole.
10. The Fair agrees to take reasonable precautions to protect concessions during non-operating hours
at Fair time, but will not be responsible for any loss or damage to goods consigned to its care. There
shall be no liability on the part of the Fair in case of damage, theft, fire, storm, or any other unforeseen
accident.
11. Samples may only be distributed from within the confines of your own space. The promiscuous
distribution of handbills, etc. on the grounds, or the placing of any advertisements on Fair property, is
strictly forbidden, unless arranged for by contract through the Fair.
12. The Fair is responsible for nightly trash pick-up in general. oncessionaires are responsible for their immediate area and accountable for its daily cleanliness, sanitary conditions and state of repair. Boxes shall be broken down and all other trash shall be in bags. If dumpster is not available, trash shall be left in front of your booth for pick—up.
13. Each Concessionaire is expected to deal honestly and fairly with the public, and the perpetration of
any fraud or deception will be considered sufficient cause for revoking privilege without compensation.
14. Concessionaire agrees to post established prices on a visible sign, with at least 1 inch letters in
compliance with Fair policy. Prices are to be established on opening day and remain through the Fair in accordance with the enclosed guidelines.
15. No lighted candles, lamps, matches, or fire of any description will be allowed in any booth, stand,
tent, or concession space. All Food Concessionaires MUST provide a certified Fire Extinguisher within their space. If you are using fryers you MUST have a certified Class K Fire Extinguisher within your space.
16. The Concessionaire shall indemnify and save harmless and release Fair and all Volunteers
associated with the Fair against any and all losses sustained by Concessionaire, for which the above
referenced Insurance policy does not respond or otherwise does not provide coverage, as a result of
claims arising in any way out of the performance of this Agreement or out of the Concessionaires
occupation of the land and premises.
17. Electricity for lighting and to power Concessionaires equipment will be provided per the attached
guidelines.
18. Concessionaire agrees that all electrical hook-ups will be made by the Fairs certified electrician.
19. All waste water shall be discharged into an approved receptacle and emptied in the designated
Sanitary Sewer.
20. Camping facilities are available at a charge of $20.00 per day. Electrical and water provided.
Sewage can be disposed of in Sanitary Sewer after being drained into an approved container or service
can be arranged at the cost of the Concessionaire.
21. The Fair reserves the right to relocate Concessionaire if it is in the best interest of the Fair;
however, no change of location shall be made without disclosure to the Concessionaire.
22. The Fair will make every attempt to place Concessionaire in a suitable location. There are no
guarantees to your sales or profitability. That is your responsibility.
23. Any privilege may be revoked by the Fair, for just cause, at any time.
24. In the event the Fair is canceled for any reason, the Fair shall not be liable for anything except the
return of monies therefore paid by the Concessionaire for the privilege of participating in the Fair.
25. The Fair and its assigned representatives shall have the power to enforce the regulations
established herein, and may from time to time, upon proper notice to the Concessionaire, establish
additional rules and regulations for the management and control of the Fair.
26. Concessionaire must comply with all City, County, and State ordinances and laws.
27. All Concessions will be inspected by the Jefferson County Health Department and must be in
compliance with their rules and regulations. A fee of $30.00 cash will be collected for each spot
permitted.
28. The Fair has the right to enter into exclusive supply agreements at competitive prices.
Concessionaires will be notified of these agreements and will be required to comply with these supply
agreements.
29. We anticipate that Coca Cola will once again be a Major Sponsor for 2012 as they have in the past.
This means that all Concessionaires MUST buy their Soft Drinks, Bottled Water, Sports Drinks and any
other Bottled Drink they wish to sell, from the Coke truck that will be located at the Fairgrounds. The
package size sold at the Fair is 20 oz. bottles. Pricing will be available on set-up day.
30. Because of power supply, Concessionaires will not be allowed to have an Ice box located behind
their booth. Ice will be available for purchase on the grounds at a cost of $4.00 per 20 lb. bag. If you
wish, you may bring your own Ice but you can not have an Ice box.
31. All Concessionaires are expected to operate within your own area. However, if you do not have
enough space within your trailer or tent and you have a need to have a refrigerator or freezer outside,
there will be an additional charge of $25.00.
32. Each concession Spot will receive 4 all week passes and 2 all week parking passes. The passes are
for you and your workers and are not to be handed to anyone else for admission.
33. The Fair can not provide ride tickets to anyone. Your passes are only good for admission and ride tickets must be purchased.
34. Alcohol and Drugs will not be tolerated on the Fairgrounds. Anyone caught in possession of, or
using either on the grounds will be removed without a refund. You are responsible for your workers.
35. Under no circumstances will the Fair refund any fees after June 15, 2012.
